(Scope of Application)Article 1
  1. Contracts for accommodation and related agreements to be entered into between this Hotel and the Guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided herein shall be governed by laws and regulations ("laws and regulations," or those based on laws and regulations. The same shall apply hereinafter) and/or generally accepted practices.
  2. In the case when the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices the special contract shall take precedence over the provisions of these Terms and Conditions, notwithstanding the preceding Paragraph.
(Application for Accommodation Contract)Article 2
  1. A person who intends to apply for an accommodation contract with the hotel shall provide the hotel with the following information.
    • (1)Name of the lodger
    • (2)Period of stay and estimated time of arrival
    • (3)Accommodation charges (per the base rate listed in the attached Table 1)
    • (4)Other information deemed necessary to the hotel
  2. Upon the request from the guest during his/her stay to extend the period of stay declared under the above item (2), the hotel will process such a request as the application for a new accommodation contract.
(Conclusion of Accommodation Contract, etc.)Article 3
  1. The accommodation contract shall be concluded when the hotel has accepted the application as stipulated in the preceding Article. The same is not applicable when the hotel can prove that it has not accepted the application.
  2. When the accommodation contract is concluded as per the preceding paragraph, the guest is requested to pay the application fee by the date specified by the hotel. The application fee set by the hotel shall not exceeding the base rate for the period of stay (3 days when the period of stay exceeds 3 days).
  3. The application fee shall first be appropriated to the accommodation charges to be finally paid by the guest. In the case where the provisions of Articles 6 or Article 18 apply, the application fee shall be appropriated to the cancellation penalty and then to the damages. The remaining balance, if any, shall be returned to the guest upon payment of the charges under Article 12.
  4. When the guest has failed to pay the application fee by the date specified by the hotel under Paragraph 2, the accommodation contract shall cease to be effective. However, it applies only when the hotel has informed the guest to that effect when it specifies the due date for the payment.
(Special Contracts Requiring No Accommodation Deposit)Article 4-1
  1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded as stipulated in the same Paragraph.
  2. In the case when the Hotel has not requested payment of the deposit as stipulated in Paragraph 2 of the preceding Article and/or has not specified the date of payment of the deposit at the time the application for an Accommodation Contract has been accepted, it shall be treated as though the Hotel has accepted a special contract prescribed in the preceding Paragraph.
(Request for cooperation in infection control measures at facilities)Article 4-2
  1. The Hotel may request cooperation from the person who intends to stay at the hotel in accordance with the provisions of Article 4-2, Paragraph 1 of the Hotel Business Act (Act No. 138 of 1948).
(Refusal of Accommodation Contractsc)Article 5-1
  1. The Hotel may not accept the conclusion of an Accommodation Contract under any of the following circumstances. However, this paragraph does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act.
    • (1)When the application for accommodation does not conform with the provisions of these Terms and Conditions.
    • (2)When the Hotel is fully booked and there is no vacancy.
    • (3)When the Guest seeking accommodation is deemed l iable to conduct himself/herself in a manner that will violate laws or act against the public order or good morals in regard to his/her accommodation.
    • (4)When the person who intends to stay at this hotel is deemed to fall under any of the following items (a) through (c).
      • Organized Crime Groups as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Groups (Act No. 77 of 1991) (hereinafter referred to as "Organized Crime Groups"), members of organized crime groups as defined in Article 2, Item 6 of the same article (hereinafter referred to as " Members of Organized Crime Groups "), associate members of organized crime groups or persons related to organized crime groups, or other antisocial groups.
      • When the person is a organized crime group or a corporation or other organization whose business activities are controlled by a organized crime group or a member of an organized crime group.
      • A person who is a juridical person and one of its officers falls under the category of an organized crime group member.
    • (5)When the person is behaving in such a manner as to be an annoyance to other guests.
    • (6)When a person who intends to stay at this hotel is a patient, etc. of a specified infectious disease as defined in Article 4 -2 , paragraph 1, item 2 of the Hotel Business Act (hereinafter referred to as "patient, etc. of specified infectious disease").
    • (7)When a violent act of demand is committed or a burden exceeding a reasonable range is demanded with regard to accommodation (Excluding cases where the person seeking accommodation requests the removal of social barriers pursuant to the provisions of Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act (Act No. 65 of 2013. Hereinafter referred to as the "Act on Elimination of Discrimination against Persons with Disabilities") on Promotion of Elimination of Discrimination on the Basis of Disability.).
    • (8)When the person who intends to stay in the Hotel has repeatedly made a request to the Hotel as specified in Article 5-6 of the Enforcement Regulations of the Hotel Business Act as a request whose burden is excessive in its implementation and which may seriously impede the provision of accommodation-related services to other guests.
    • (9)When the Hotel is unable to provide accommodation due to natural calamities, malfunction of facilities and/or other unavoidable causes.
    • (10)When the case falls under the provisions of Prefectural Ordinance Article (No.5 ).
(Explanation of refusal to conclude a contract of accommodation)Article 5-2
  1. The person who intends to stay may request the Hotel to explain the reasons for its refusalto enter into a contract of accommodation in accordance with the preceding article.
(Right to Cancel the Contract by the Guest)Article 6
  1. The guest is entitled to request the hotel to cancel the accommodation contract.
  2. When the guest has canceled all or part of the accommodation contract for his/her personal reasons (excluding the cancellations made before payment of the application fee on the due date requested and specified by the hotel under Article 3-2), the hotel shall request the cancellation penalty as listed in the attached Table 2. However, in the case where the hotel has accepted the special agreement under Article 4-1, this provision shall apply only when the guest is informed of the obligation to pay the cancellation penalty when it has canceled the accommodation contract.
  3. When the guest has not shown up as of 22:00 on the check-in date without prior notification to the hotel, we may consider that the accommodation contract has been canceled by the guest and process it accordingly.
(Right to Cancel Accommodation Contract by the Hotel)Article 7-1
  1. The Hotel may cancel the Accommodation Contract under any of the following circumstances. However, this paragraph does not mean that this hotel may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act.
    • (1)When the G ue st is de eme d l iable for conduc t a nd /or ha s conduc te d himself/herself in a manner that will violate laws or act against the public order and good morals in regard to his/her accommodation.
    • (2)When it is recognized that the Guest falls under any of the following items (a) through (c).
      • When the Guest is a crime group , a memberofacrimegroup, a quasi-constituent of a crime group, or a person related to a crime group, or any other antisocial group.
      • When the Guest is a juridical person or other organization whose business activities are controlled by a crime group or a member of a crime group.
      • when the Guest seeking accommodation is a corporation which any of directors are proven to be a member of an organized crime group.
    • (3)When the Guest is behaving in such a manner as to be an annoyance to other guests.
    • (4)When the Guest is a patient, etc. of specified infectious disease.
    • (5)When the Guest who intends to stay at the accommodation commits a violent demand act or asks for a burden exceeding a reasonable range with regard to the accommodation (except when the guest requests the removal of social barriers as provided in Article 7, paragraph 2 or Article 8 , paragraph 2 of the Act on Elimination of Discrimination against Persons with Disabilities).
    • (6)When the Guest repeatedly makes a request to this hotel that is so burdensome in it simple mentation that it may seriously impede the provision of accommodation - related services to other guests, as specified in the Article 5-6 of the Enforcement Regulations of the Hotel Business Act.
    • (7)When the Hotel is unable to provide accommodation due to natural calamities and/or other causes of force majeure.
    • (8)When the case falls under the provisions of Prefectural Ordinance Article (No.7 ).
    • (9)When the Guest does not observe prohibited actions such as smoking in bed, tampers with fire-fighting facilities and otherwise breaches Hotel Regulations stipulated by the Hotel (restricted to particulars deemed necessary in order to avoid causing fires).
  2. If the Hotel has canceled the Accommodation Contract in accordance with the preceding Paragraph, the Hotel shall not charge the Guest for any of the services during the contractual period he/she has not received.
(Explanation of Cancellation of Accommodation Contract)Article 7-2
  1. In the event that the Hotel cancels the accommodation contract in accordance with the preceding article, the Guest may request an explanation of the reasons for such cancellation.
(Registration)Article 8
  1. The Guest shall register the following particulars the Front Desk of the Hotel on the day of accommodation:
    • (1)Name, address, and contact information of the Guest(s).
    • (2)Nationality and passport number for foreigners who do not have a domicile in Japan.
    • (3)Other particulars deemed necessary by the Hotel.
  2. In the case when the Guest intends to make payment of the charges in accordance with Article 12 by any means other than Japanese currency, such as traveler's checks, coupons, credit cards, etc., these credentials shall be shown in advance at the time of registration in accordance with the preceding paragraph.
(Occupancy Hours of Guest Room)Article 9
  1. The guest is entitled to occupy the contracted guest from 15:00 on the check-in day to 11:00 on the following day. However, if the guest stays for more than one night, he/she may occupy the guestroom all day long, except for the days of arrival and departure.
  2. Notwithstanding the preceding paragraph, the hotel may allow the use of the guest room outside the hours stipulated in the same paragraph. In that case, the following additional charges shall apply depending on the extra hours.
    • (1)1/3 of the room rate (or 30% of the amount equivalent to the room rate) for up to 3 hours
    • (2)1/2 of the room rate (or 50% of the amount equivalent to the room rate) for up to 6 hours
    • (3)The full room rate (or 100% of the amount equivalent to the room rate) for 6 hours or more
  3. The amount equivalent to the room rate under the preceding paragraph shall be 70% of the base rate.
(Observance of Usage Rules)Article 10
  1. During the stay, the guest must observe the usage rules prescribed by the hotel. The notification of such rules is posted inside the premises
(Business Hours)Article 11
  1. The business hours of the Hotel main facilities are as follows, and those of other facilities, etc. shall be notified in detail by brochures as provided, notices displayed in various places, the Service Directory in guest rooms and other means.
    • (1)Service hours of the Front Desk, cashier, etc.:
      • Closing time 0 am
      • Front service 0 am
      • Exchange Service 10 pm
    • (2)Service hours for food and beverages (facilities):
      • Breakfast 7 am-9 am
      • Dinner 5:30 pm-9 pm(Last order 7 pm)
    • (3)Incidental service facility hours.
      • Banquet, wedding 10 am-6 pm
  2. The business hours specified in the preceding Paragraph are subject to temporary changes due to unavoidable circumstances of the Hotel. In such cases, the Guest shall be informed by appropriate means.
(Payment of Fees)Article 12
  1. The breakdown of the accommodation charges and other fees payable by the guest shall be as listed in the attached Table 1.
  2. The guest shall make the payment of the accommodation charges and other fees under the preceding paragraph at the front desk at the time of his/her departure or upon our request, in cash or traveler's checks, accommodation vouchers, credit cards, or other means approved by us.
  3. Even if the guest chooses not to stay at the hotel, the accommodation charges still apply when such a choice is made after the room is made available to the guest in a usable condition.
(Our Obligations)Article 13
  1. We will compensate the guest for damages sustained in the performance or due to the non-performance of the accommodation contract or the related agreements. However, the preceding shall not apply where the damage is caused by the reason not imputable to the hotel.
  2. The hotel has taken out an innkeeper's liability insurance covering damages caused by fire and other disastrous events.
(Procedures upon Unavailability of Contracted Guest Rooms)Article 14
  1. When the contracted room has become unavailable to the guest, the hotel shall arrange accommodation under the same conditions insofar as possible with the consent of the guest.
  2. Notwithstanding the preceding paragraph, should the hotel be unable to arrange another accommodation, we will pay the guest the compensation fee equivalent to the cancellation penalty as the reparation. However, the preceding shall not apply when the hotel is not liable for such unavailability.
(Handling of Deposited Articles, etc)Article 15
  1. Except in the cases of force majeure, the hotel shall compensate for the lost, damaged, or otherwise harmed articles, cash, and valuables deposited at the hotel front desk by the guest. However, if the guest does not declare the type and value of the deposited cash and/or valuables at our request, the amount of compensation payable to the guest shall not exceed 30,000 JPY.
  2. We will compensate for the loss of or damage to the articles, cash, and valuables brought into the hotel by the guest and deposited at the front desk if such loss or damage has been caused willfully or in gross negligence on the part of the hotel. Otherwise, where the guest has not declared the type and value of the article in advance, the amount of compensation payable to the guest shall not exceed 300,000 JPY.
(Custody of Baggage/Belongings of the Guest)Article 16
  1. The hotel shall keep the baggage brought in the hotel before the arrival of the guest responsibly only if we gave advance consent to do so. Such baggage shall be handed over to the guest at the front desk when the guest is checking in.
  2. When the baggage or personal belongings are left behind at the hotel after the guest has checked out, and the owner is identified, we will contact the owner for instructions. If we cannot get any instruction from the owner, or the owner is unknown, we will keep it for seven days from the day it is found, and then hand it over to the nearest police station.
  3. In the case of the above Paragraph 1, our obligation for custody of the baggage/belongings of the guest under the preceding two paragraphs shall be subject to the provision in Article 15-1. In the case of the above Paragraph 2, our obligation for the same shall be subject to the provision of Article 15-2.
(Our Responsibility for Parked Vehicle)Article 17
  1. The hotel only lends a parking space to the guest who uses the parking lot of the hotel. We shall not bear any responsibility for the parked vehicle regardless of whether the vehicle key is deposited to us or not. However, we are liable for the damages caused by willful misconduct or negligence on the part of the hotel in managing the parking lot.
(Obligation of the Guest)Article 18
The hotel only lends a parking space to the guest who uses the parking lot of the hotel. We shall not bear any responsibility for the parked vehicle regardless of whether the vehicle key is deposited to us or not. However, we are liable for the damages caused by willful misconduct or negligence on the part of the hotel in managing the parking lot.

  1. The base rate is per the schedule of fees posted at the front desk.
  2. Child rates apply to elementary school pupils and younger children. 70% of the adult rates is charged where meals and bedding equivalent to those provided to adults are provided, 50% where meals and bedding for children are provided, and 30% where only bedding is provided.

Note

  1. The percentages (%) are the ratios to the base rate.
  2. Where the contracted days of stay are shortened, the penalty equivalent to the accommodation charges for one day (the first day) will be collected regardless of the shortened number of days.
  3. No penalty will be charged for a partial cancellation on 10% or less (fractions to be rounded up, if any) of the total number of guests in a group (with 15 or more people) as of the date 10 days before the check-in date (or the date when we accept the application if such application is accepted after the said date).
